By using Moomby, you confirm that:

You are 18 years or older
You are the parent or legal guardian of the children you discuss
You accept these terms

2. What Moomby Is (and Isn't)

Moomby IS: An AI companion for parenting support.

Moomby IS NOT: A human; medical advice or diagnosis; therapy or mental health treatment; a substitute for professional support; or emergency or crisis intervention.

You remain fully responsible for all parenting decisions and your family's wellbeing.

3. Subscription and Payment

Moomby is a paid subscription service
Pricing and billing terms are displayed at signup
You can cancel your subscription at any time
Refunds are handled according to app store policies (Apple App Store, Google Play)

4. Voice Recording and Privacy

By using Moomby's voice feature, you agree that:

We record and transcribe your voice messages
Voice recordings may include background sounds, including children's voices
Transcriptions are used only to provide Moomby's service
Your voice recordings are not used to train AI models
Voice processing is handled by carefully selected voice processing providers operating under contractual data protection obligations
Voice recordings are retained for a maximum of 1 day, then permanently deleted
We do not use voice recognition, voiceprint identification, biometric identification, or speaker profiling technologies
We use technical safeguards, including automated filtering and data minimization, to prevent personally identifiable information such as names or contact details from being sent to voice services. If a parent voluntarily includes a name in a voice message, that audio is processed solely for transcription, retained for a maximum of 1 day, and not used for identification, profiling, or model training. If an unintended disclosure is detected, we will take prompt corrective action and notify affected users where required by law.
All data is encrypted in transit and at rest

5. Privacy Protection

Your identity and your children's identity are protected. We remove direct identifiers such as names before AI processing and use abstract identifiers to minimize identifiability. When our AI discusses your family, it uses pronouns and general references—not names. See our Privacy Policy for full details.

6. Your Data

Your data may be processed in the United States and other jurisdictions, using appropriate safeguards as required by law
We do not sell your data or share it with advertisers. Certain information is processed by carefully selected service providers strictly to operate Moomby. All service providers are bound by contractual data protection obligations.
You can request deletion of your data at any time
We will notify affected users of a data breach as required by applicable law.

For EU/UK Residents: Your voice and conversation data is processed in the United States, which is necessary to provide Moomby's service (GDPR Article 6(1)(b)). Where personal data is transferred outside your country of residence, we rely on appropriate safeguards such as Standard Contractual Clauses or equivalent legal mechanisms where required. You maintain all GDPR rights including: right to access your data, right to deletion ("right to be forgotten"), right to data portability, right to correction, right to withdraw consent at any time, and right to stop using the service at any time. 7. When to Seek Professional Help

If you or someone in your family is experiencing thoughts of harming yourself or others, persistent mental health concerns, medical emergencies, or child safety concerns, please contact appropriate professional support immediately. Moomby is not a substitute for professional help.

8. Acceptable Use

You agree not to use Moomby for any unlawful purpose, attempt to access other users' data, interfere with or disrupt the service, or use Moomby on behalf of anyone other than yourself and your family.

9. Limitation of Liability

Moomby is provided "as is." We are not liable for decisions you make based on Moomby's suggestions, technical issues or service interruptions, or any indirect or consequential damages. Our total liability is limited to the amount you paid for Moomby in the 12 months preceding any claim.

Nothing in these Terms limits or excludes liability where such limitation is prohibited by law.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Moomby will be resolved through binding arbitration in Austin, Texas.

11. Changes and Termination

We may update these terms with notice. You can stop using Moomby and cancel your subscription at any time. We may terminate accounts that violate these terms.
